1. Introduction
This document is an electronic record in terms of the Indian Contract Act, 1872, the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. 8. Children’s Privacy
We do not knowingly solicit data from children under 18 (eighteen) years of age. By using the Platform and Services, you represent that you are at least 18 (eighteen) or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Platform. If we learn that personal information from users less than 18 (eighteen) years of age has been collected, we will deactivate the Services and take reasonable measures to promptly delete such data from our records. 9. Data Retention
In case you request for deletion of your Information or cease to use our Services, we may retain such portion of Information and for such periods as may be permitted/ required under applicable law and notwithstanding anything contained herein, the Company may retain data after account deletion for reasons including but not limited to the following purposes:
9.a. if there is an unresolved issue relating to your account, or an unresolved claim or dispute;
9.b. if we are required to by applicable law;
9.c. in aggregated and / or anonymized form; or
9.d. if necessary for its legitimate business interests, such as fraud prevention and enhancing users’ safety and security.
10. Your Rights
10.1. Right of access: You have the right to access any Information that we process about you and to request:
10.1.a. information about the categories of your personal data that we process and the processing activities we carry out on such data;
10.1.b. the identities of all other data fiduciaries and data processors with whom we have shared your personal data (including the categories of personal data so shared); and
10.1.c. any other information relevant to your personal data as required under the applicable data protection law.
10.2. Right to rectification: If you believe that we hold any incomplete or inaccurate data about you, you have the right to ask us to correct and / or complete the Information.
10.3. Right to deletion: You also have the right to request deletion of your Information, however, please note that in such case, the Company may not be able to provide the Services to you.
10.4. Right to object and / or restrict: You have the right to object / restrict the processing of your Information by utilizing the opt-out mechanisms that we provide to you, in which case all or certain Services may not be available to you.

10.6. Right to withdraw your consent: If you do not agree with this Privacy Policy, you may refuse or withdraw your consent any time, or alternatively choose to not provide us with any Information. Such request for withdrawal of consent must be sent from the user’s registered email address.
10.7. Right to appoint a nominee: You have the right to appoint a nominee to exercise the rights on your behalf in the event of your death or incapacity to exercise your rights.
10.8. If we receive a request from you to exercise any of the above rights, we may ask you to verify your identity before acting on the request. This is to ensure that your data is protected and kept secure. We will handle your requests related to the exercise of your rights within 30 (thirty) days upon the receipt of your request. 11. Locations of Data Processing
11.1. We have deployed the hosting service providers located in India and we have also engaged with third -party service providers to store the Information collected pursuant to this Privacy Policy (for example, Azure, AWS), pursuant to which the Information may be stored inside or outside India.
11.2. Any data processed by us in accordance with this Privacy Policy may be brought to India, whether or not the data originates from India, for the Purposes.
11.3. While all reasonable attempts have been taken from our end to ensure the safe and secure storage of your data, we shall not be liable for any data breach on the part of the third-party cloud service infrastructure provider that was beyond our control.
12. Data of Persons Outside India
12.1. With respect to persons whose data may be collected, stored, processed and transferred pursuant to this Privacy Policy, such persons, by accepting this Privacy Policy, agree and acknowledge that the Company is only a data processor/ collector (or similar nomenclature) under the relevant laws of the jurisdiction and is not a data fiduciary and such persons provide their data / allow the Company to access their data in accordance with this Privacy Policy.
13. Changes & Updates to Privacy Policy
13.1. This Privacy Policy may be amended by the Company in its sole discretion at any time.
